Inadequate provision to insure the building and/or reinstate the property or building
Potential landlord repossession using a Section 8 Housing Act Notice due to outstanding ground rent under a long lease, as a result of the landlord interpreting the long lease as an Assured Tenancy or AST due to the amount of ground rent stipulated
Lender only policy to cover the risk of forfeiture due to a future breach of the long lease by the borrower, where the lender is not notifiied due to the lack of a mortgagee protection clause in the lease.
Inadequate provision to maintain and repair the building in accordance with sections 5.14 and 5.15 (or such relevant paragraph) of the UK Finance Mortgage Lenders' Handbook, where the buyer/borrower is not obtaining a survey
Lender only policy to cover the risk of forfeiture due to a future breach of the long lease by the borrower, where the lender is not notified due to the lack of a mortgagee protection clause in the lease, or in the event of a section 8 Notice being issued
Leasehold title to the property may be defective and rights of access granted in the lease may be ineffective, as the lease plan is missing, illegible or uncoloured, and title to the property is registered with Good Leasehold title only
